Implementation of a ban on the export of certain hazardous pesticides from Germany

This legal opinion shows how an export ban on certain hazardous pesticides can be implemented in a particularly comprehensive manner. The experts advocate a reform of the Plant Protection Act so that, in addition to pesticide products, the export of pure pesticide active ingredients can also be regulated with legal certainty. For the selection of the substances to be regulated, the report recommends a link to the approval status at EU level, so that only active ingredients approved in the EU or products containing these active ingredients may be exported. The report was prepared by Mirka Fries and Ida Westphal on behalf of the European Center for Constitutional and Human Rights (ECCHR), the Heinrich Böll Foundation, the INKOTA network, the Pesticide Action Network (PAN Germany) and the Rosa Luxemburg Foundation.
